Can I be kicked out from my apartment for calling the health department because I took it upon myself to get a 2inch piece of popcorn ceiling and sent it to lab it came back with 1% for asbestos and I was concern because I have a 6yr old with asthma

I was always under the impression that asbestos is fairly benign unless it is disturbed, or as you say "get a two inch piece of ceiling."

I am sure that your popcorn ceiling was painted over when installed. Asbestos which is encapsulated in such a way presents no adverse environmental danger. Same goes with old linoleum floor tiles which contain asbestos. The only time that encapsulated asbestos presents a problem is when you tear it up....like you did. If you like the place, slap some paint on that 2" square and relax, your daughter is safe.

Maybe the landlord decided he needs the place vacant to perform a proper abatement?

Afterall, landlord is now aware and will have to disclose or abate.

I would not want to risk abatement in an occupied unit having been put on notice.

I would evict you under the alterations and improvements clause of my lease. Asbestos is harmless until disturbed so you literally caused a health hazard for yourself and your child, bravo. In my case you would also owe the early termination fee in the lease which states you owe the fee if "move out at Landlord’s demand because of breach of this Lease Agreement by Tenant." As for grounds here the law states that if, by the tenants actions, the tenant endangers the health or safety of the landlord, landlord's agents or another tenant it is grounds for immediate termination of the lease and most states have a law that states as such. You disturbing an asbestos ceiling has endangered your health, your child's health, the landlord's health, and potentially future tenant's health.

Yep, nothing illegal here and you made a safe situation unsafe. Never disturb what you think could be asbestos. Next time, do a bit more research.

It is well known that asbestos is safe if left undisturbed and now that has been breached, the only recourse may be to have the asbestos professionally removed which will cost a few thousand dollars. You could be looking at paying for its removal, paying for a ceiling finish, and paying for your own housing while it is all being done.

You should have had the air sampled if you were concerned what your child was breathing. If you were concerned with the ceiling, you should have asked the landlord first.

What right do you have to destroy any part of the landlord's property.


Some things just give the renters a bad name. Hope the landlord places you on the "list".
