i am on a 12 month lease that ends october 1st. in the contract it says that it will automatically roll over into another 12 month lease. it is now september 9th and i haven't given 30 days notice that i want to make the 12 month lease a month to month lease. i dont plan on living in the apartment another year. can i get out of the apartment before the 12 months are up if they dont let me do a month to month. i wouldnt be able to get ready to move before my lease is up. i would need another 2 months or so.

Talk to your landlord now! You should have addressed the issue within the time period mandated but now you need to get in touch with your landlord as quickly as possible to explain your situation.

Assuming you do not sign a new lease, you will be a month to month tenant automatically (based on what you said is in the lease). At that point, either you or the LL can give whatever notice is in the state's statutes. So, you could be asked to leave at the end of October. OR, you can send the LL a notice saying what month you intend to leave.

But he said his lease says it rolls over TO ANOTHER 12-MONTH LEASE, not to month-to-month.

And as an aside, I am always amazed when posters ask questions like these instead of just talking to the landlord first.

Without accepting and signing for another term, I don't see how this could be considered a one-year lease.
It would be an eternal one.

It wouldn't be "eternal" because a notification provision is written into the lease.

I gather you're familiar with this type of lease?
Is it just that, minus an objection, the lease will roll over without signature?

Yes, I've seen leases such as this. Yes, if the lease includes such a clause it's perfectly legal and a new signature isn't required. People get into trouble all the time by not taking the time to read and understand what they're signing agreement to!
