Actually, in many places in NYC and Suffolk & Nassau Counties, if the apt is found to be illegal, the OWNER is told to evict the tenant (by the building inspector) but the owner has no legal standing to evict and cannot disable the kitchen/utilities until the tenant leaves voluntarily. The landlord/owner is between Scilla and Charibdis (aka a rock and a hard place) because the fines are mounting daily but there is no remedy for the occupancy, not for non-payment, not for habitability.
