Yes, I agree paying someone is a bad idea. However, it's better than the court system allowing them to live there rent free for 6 months.
NYC laws are pro-tenant. It's unfortunate because it could potentially cause a landlord to go into foreclosure. As if we didn't have enough short sales on the market already. Most of the landlords I know depend heavily on rent payments and are currently struggling to heat and maintain their buildings.
In what state does it take less than a month to evict a tenant? I need to buy houses there
Hi,
What's the situation now? Our tenant refused for the settlement idea. Probably if he get chance to live here six months it will be beneficial for him. Now we are going behind lawyers.....

OR....you could invest your money in bringing your apt. up to code and making it legal. That way, next time, hopefully, you would get a good, law-abiding tenant. And if you didn't? You would at least have the law (and the courts) on your side.

Did you already serve your tenant with a 30 day notice? I did.
If rent is due on the 1st, you can file a 3 day notice to pay or quit on the 2nd if rent isn't paid.
On the 5th (or 3 business days after filing), you can file in the courts for a "speedy eviction" between 5 and 12 days out, if you aren't asking for money (you can still file in small claims against them later). So call that now between the 10th and 20th. If the judge grants in your favor, which they usually do, then the sheriff will go out within a couple of days.
We've had some times we've been as little as 3 weeks total from filing to sheriff. Best case, I could see it happening in as little as 2 weeks if the courts are slow.

I seriously doubt it. I don't know about NY, but in most states if you live in a place you are required to pay rent while you are there. If you've already been evicted I doubt you will get any sympathy from a judge either. And you'll owe thousands to your landlord in legal fees. Don't be a freeloader and take responsibility - your job loss is not your landlord's problem.
a friend was living in a 3 family home in queens with her husband and 3 yr old son. her landlord decided to stop heating the place in the middle of winter. this is illegal in NYC.
in the process of filing formal complaints with the relevant city agencies they discovered that the basement unit the landlord was living in was illegal, and although their apartment was original to the building, the presence of an illegal apartment on the property meant that all the units were illegal.
they stopped paying rent, the landlord sued for eviction, and when they appeared in court the judge did not award the landlord any back rent or court costs and gave the tennant 30 days to vacate.
