I am being terminated at my work due to bureaucracy reasons inside the company.

The HR wants me to send a resignation email, saying that the agreed upon date will be my last date at the company.

However, I was reviewing unemployment benefits website and it says that if an employee resigns without a good cause (such as domestic voilence, sexual abuse etc), then the employee is not eligible for unemplyment benefits.

Has anyone been in such a situation before and what's a good reason they have mentioned in the email and still availed unemployment benefits from EDD.

Or if the company has terminated them, what sort of reasons have the company mentioned so that the employee is still able to avail unemployment benefits.

Can you please share your experience if you have been in this situation or can you recommend me to an attorney who can help answer such questions.

Highly appreciate your time and help in this regard.

If they told you this in person, I wouldn't send them anything at all. I would ignore their requests.

If they sent you an email requesting this, I would return the email to them with: "I'm not resigning. Your termination of my employment is involuntary."

I wouldn't sign anything. If they want me gone, they'll have to give me my walking papers.

It appears the company is trying to avoid paying unemployment benefits, by asking you to submit a falsified email saying that you voluntarily resigned. I would not send this email.

I would request a meeting with HR and your manager to negotiate the terms of your release. Negotiate for UI benefits and other benefits, such as health insurance, severance pay, etc. Get everything in writing. If possible, get your employer to “help” you obtain UI from the EDD.

As they say:: “If you’re going down, go down swinging!”

Your mileage may vary.

Don't sign anything! Let them fire you and then you can collect unemployment.
