Gregg Abbot is bowing down to Trump by getting closer to having his "sanctuary city" law in place, leaving state funds away from counties and cities that don't follow by their rules. But with Houston, Austin and Dallas rejecting them, that's three of your most important cities, where will funds go? We're not sure what San Antonio will do yet. Will they all go to Arlington now?

El Paso is prepping a lawsuit. Nueces County Republican Sheriff(Corpus) basically came out and said it's a terrible bill yesterday(and he complies with ICE detainer requests now) which follows the CCPD chief saying his department doesn't and won't enforce immigration law.

I think it may die in the house. A bill with just the "must cooperate" language was killed last session by law enforcement alone on resources and command grounds. Police chiefs weren't excited about any officer getting to leave their assignment and go enforce immigration law.

If it does pass be ready for cities to start yanking highway matching funds and right of way contributions to plug any budget holes. The state doesn't give cities nearly enough money for the kind of leverage they are trying to exert.

Houston is not actually sanctuary city, so its unclear what effect the bill will have on Houston.

Definition of sanctuary city is a bit 'fluid'. Currently, it means that it is a city/county that doesn't do exactly what the governor wants.

You notice the quote from the article?

Describes Austin exactly, as well.
Yeah there's a theory that this whole thing is because without a democratic president the governor needs some other government to blame everything on and he's picking democratic cities(especially Austin).

The bill is tailor made to make complying with it and various court precedents pretty much impossible so if it passes it will get used by both sides to pick fights with each other.

Harris County has a law that says they aren't forced comply with the federal government (or ICE) for immigration.

Now, again, what's actually a sanctuary city or not a sanctuary city is never official, but its not less of one then Austin or Dallas. That's why Houston has so many immigrants. The only difference is that Austin is trying to pass a law to do exactly what the government is telling them not to do.

What law is that? As far as I can see there is no law preventing the Houston Police / Sheriff from working with ICE.... it has a police policy of doing so only a case by case basis, and it still does turn over some persons to ICE on a regular basis.

The bill in legislature says a sheriff or police department can't have a policy against enforcing immigration law even at the individual officer level. It basically would establish criminal penalties for not letting officers enforce immigration laws at their own whim.

Your right there aren't any sanctuary cities as they have been traditionally defined but this law goes a step further in definition. It will also make communities less safe by making sheriffs and judges prioritize undocumented immigrants over more violent criminals in jail overcrowding decisions since it requires undocumented to be held for ICE.

Of the few detainer requests by ICE that weren't complied with virtually all of them were because the person was transferred to another jurisdiction on a warrant. A handful weren't turned over because ICE didn't collect them before they constitutionally were required to be released.

There's also a good argument that ICE should only take over at the prison level after they've served their sentence. If they pull someone out of jail then that's pre conviction. If they haven't been convicted yet it can't be used as evidence in their deportation hearing and while in ICE custody they can't be tried and convicted for the crime they commited. I don't know about you but I'd rather go to Mexico than prison.

It will be interesting when there is a Democrat president again and states/cities decide they aren't going to enforce federal gun laws.
