As someone previously mentioned, we are allowed to legally free someone who has broken the law. It's called jury nullification. This is because there are cases in which following the letter of the law would cause an injustice. This is also why we are allowed a jury of our peers and not professional jurors, because those citizens who are most like you are also most likely to understand your situation.

I think prostitution should be legal.

The fastest way to legalize it might be to prosecute johns.
In marijuana busts it is the pusher and the addict who get penalized, no? Well, what's the difference with hookers? Both should be arrested. If this were the case there would be a lot more voices crying for legalization.

Of course, there is a 'just say no' element in this country that would forbid birth control and knowledge of it to young people and would tell married couples who don't want kids to abstain from sex because abortions would be forbidden. With such a radical background, amounting to sexual terrorism, I doubt if prostitution will ever be legal.

I have never received a jury duty summons. It is my dream to help acquit or hang a jury on a b.s. charge. I wonder is being a registered Libertarian has anything to do with my never receiving a summons. Government, law and order do not care for my kind.

There's is an interesting book called David's Hammer that focuses on judges bucking the system and favoring judicial activism on the basis on the Constitution.

Most nations in the world (including the two that border The US), allow consenting adult prostitution, in one form or another, to occur legally. For some of those countries, it is a simple matter of priorities regarding law enforcement resources. For others, it involves a national policy of not allowing the government to interfere with people's personal sexual decisions.

In The United States, there exists an unholy alliance between the religious right and political feminists regarding the sexual behaviors of other people. Both of these groups want to limit the sexual activities of other people to those which fit into there defined ideologies. The religious right and feminism have prominent ideological input into the Republican and Democratic Parties, respectively. So personal sexual freedom is attacked from both ends of the US political spectrum.

Prostitution should revert to its non-criminalized status (common in The US prior to The Mann Act). It should be controlled by the sex workers themselves. The only role of law enforcement should be the legitimate investigation of sexual slavery and the sexual exploitation of minors. When it comes to the right of adults to choose--and be responsible for-- their own sexual behavior; we have no rational basis for consulting religious beliefs, nor should we aspire to become a Swedish-style feminocracy.

yep, good point - now what is the deal over in Sweden anyway?

seems to be very egalitarian , especially if you are a woman - how does this work out?

What's with Sweden? Are you referring to the 'sex by surprise' charges?

The charges against Assange (which, even if true, constitute criminal behavior in no country other than Sweden) are only one manifestation of the issue. I'm referring primarily to Sweden's draconian 2000 overhaul of prostitution law--the so-called "Swedish Model". In Sweden, it is always legal for an individual (usually a woman) to sell sex. It is always illegal for an individual (usually a man) to purchase sex. The most vocal critics of this legislation are the sex workers themselves. I remember reading about a family that rented a house that used to be a "house." Even though it was closed years earlier, potential johns kept coming. I could see their frustration. The building was torn down years ago.

How can being able to sell but not buy, be a form of equality - isn't this the same as punishing the addict, but letting the dealer continue their trade?

supposedly PC Sweden does not seem so PC after all.

and what is 'sex by surprise' , anyone know? , thanks
