I was wondering if anyone had any advice or knowledge about early occupancy. I have been living in a house since September 08, waiting to close on a house that was in probate(which i did not know of until 2.5 weeks prior to our original closing date). We waited patiently for the sellers to get the house out of probate, in the meantime, they were suppose to get all the original contract items fixed and lender requirements met. We are currently not in contract because we opted to not charge the sellers with excessive contract extension fees. Anyways, after months (almost a complete year) of waiting for the sellers to do all the required repairs, they are threatening to kick us out of the house because we have not put a new contract on the house. We have been paying $500/mo on rent since September and now all I want to know is if I don't decide to put a contract on the house, what legal problems (if any) will I get from the sellers. Keep in mind that our earnest money and house contract have been canceled and returned and from what I understand from our Realtor, we are not obligated to do anything since they signed on a canceled contract and that the reason the contract was canceled was due to their legal issues with probate and could not sell the house.

Since no one's chosen to tackle this question, I suggest you contact a real estate attorney for advice.
