Hi, new to the forum and I was hoping for an answer to a quick question of mine.
I filed for unemployment in New York State on December 2008 for work done the previous year. I was collecting until January of this year...I have around 25-30 weeks left on this claim from extensions. In January, I took an independent consulting job where I was paid and will be issued a 1099 for my 2010 taxes. I was recently let go from that job (mutually, my work was finished), my question is, can I now go back to that old unemployment claim and finish it, even if I took work and subsequently stopped?
Typically, you would not b e eligible since your benefit year would be over. That being said, with EB and EUC, I am uncertain how it works and whether your benefit year gets extended.
Well...my benefit year ended in Dec. 09 but I called and reopened the existing claim because of emergency benefits, thus the reason why I have around 25-30 weeks left on that claim, with my benefit year now ending at the end of this year.
1099 work affects your UE benefits as paid at the time, but as you don't have an employer paying into UE you don't satisfy the criteria to open a NEW claim. I think the way it goes is that you can still go back on your original claim in that case.
They may recalculate your base year as you did have earnings, but not too sure on that side of it. The best thing to do would be to contact them and see if you CAN re-open your claim.
Well, it's not that I have to reopen my claim...the claim is still open. I could go in and claim benefits right now, I just haven't. Perhaps I should just call the NYSDOL.
The claim is still open, but you may have to "re-activate" it. The only ones that can really tell you what will happen in your situation is UE themselves.
