In June 2008 I applied for unemployment for the first time and have to serve the one week waiting period. In february 2010 while I was receiving federal extension benefits I got a new job. This new company lays off employees every summer, so when I was laid off on June 2010 I resumed my fed extension benefits. EDD told me my extension benefits will be paid for only four weeks more, because the amount that I earned during the months worked qualified for a new claim. So, I did file a new claim on 07/04/10, but since I was being receiving extension benefits on June 2010 (no exhausted) and I filed a new claim I do not have to serve the waiting period. This exception was granted after I filed an appeal form and I pointed the exception stated in EDD'S Guide of Benefits.
Now a year later I reopening a claim, because I am laid off this summer 2011, and I found out Edd is deducting the first week of my claim as a waiting period. I believe the situation was alredy resolved when they granted me the exception last year. This is not a new claim, it is a continous claim until expires in a few weeks. Once this claim opened on 07/04/2010 expires and I open a new claim then I have to serve the waiting period. This part is very clear.
Does anyone have experienced a situation like this before and tell me where it states that I have to repay something that i was granted by the appeal board?
