Well I won! The letter came in today and this is exactly how it read:
"The claimant was willing and available for work for the 11:00pm to 7:00am shift and willing to work the 7:00am to 3:00pm shift. She also is available to work Thursdays, Fridays and weekends. She has applied for positions that offer those hours. She was willing to discontinue her classes if offered work. While working for her employer, she also attended classes. The determination of the deputy is hereby reversed."
I want to thank EVERYONE who helped me. I truly appreciate it. I honestly don't think my employer will appeal because this is the 2ND time he wasn't on the phone for the fact finding interview. He put the administrative assistant on the phone instead and she literally had nothing to say. But if he does, I'll be prepared. Thanks again!
