CALIFORNIA

i was denied benefits, now appealing. Employer claiming I tried to steal company equipment. They are stating my supervisor caught me with equipment as I walked out the office.

THIS IS FALSE AND NEVER HAPPENED.

There is no video evidence, just my employer’s false claim.

If the burdon is on them to prove misconduct, how would this accusation fly during the appeal? How can they prove it with no other witnesses?

How do I defend? Is me saying “that accusation is false, and they cannot prove it” enough? Or can they just accuse me of everything under the sun without evidence?

I'm assuming you are referring to unemployment. Probably a good idea to consult an employment law attorney. Employment law is rather complex. I'm not sure much help you are going to get from city data. Do understand your former employment has attorneys, so best to equal the playing field.

im accused of trying to steal a printer. how is their attorney going to prove that? burdoun is on them to prove wilfull misconduct. all they need to do to prove wilfull misconduct is some BS lie from my supervisor and im finished?
