My wife and daughter were recently in a minor traffic accident in Maryland, on the beltway. Here is the scenario. All cars involved were traveling within the posted speed. My daughter signaled to change lanes to her right, she started to change lanes but noticed another vehicle signaling/proceeding into her intended lane at the same time. She never fully left her lane, so she proceeded to stay in lane where she was. At the same time, a vehicle to her left, noticed she was moving right and proceeded to get into her lane, not waiting for her to fully un-occupy the lane, when she moved back to the center of her lane the accident occurred. The officer on-scene gave her a warning stating that once you signal intent to change lanes, you give up the right to that lane, even though you have not fully left that lane. So was she supposed to continue into the lane that the other car had gotten into. Hit him anyway. NO. But supposedly this is Maryland law. It should have been a no-fault accident. Thoughts ???

That sounds like nonsense. Intent or not, the other driver cannot just move into an occupied lane. It is his responsibility NOT to hit another vehicle. I'd certainly go to court on this - even if just to get a reasonable explanation from a judge.

The cop is wrong. If she had gotten a ticket then you should fight it in court.

If the other driver that went into her lane was a "nervous" driver, then there would not have been an accident.

IMO, it's the "bold" drivers that create most of the accidents. More people should be "nervous" drivers because nervous=careful and bold=aggressive.

IMO, you can't assume that the other driver have left their lane until they have completely left their lane. If they did not leave their lane completely, they are technically still occupying that lane.

I see this ALL the time with my fellow Maryland non-driving drivers. Im always having to stare people down that try to merge into my lane before they even realize what they are doing. I drive a freaking Towncar and still people act like they dont see me. I would go to court, police make about $47,000/ year they dont be knowing a damn thing
