I am a waitress and I had an incident where I caught a prep/cook lookin up my skirt as I stood by the food window I cursed at him and he acted dumb then literally ten seconds later it occurred again and I confronted him he turned away... I started talking to two other co-workers (waitresses) about it because they also saw him and were standing next to me, we were shocked.. I reached for my food and stood for a few seconds talking to them then walked away, the two girls followed me to tell me that he had his phone underneath my skirt and confronted him and then threw his phone across the floor.. appartently when I stood to talk to them my back was facing him and as I walked away they saw what he was doing and one girl told him off then went to tell me ...
We tell another waitress who then states he went outside in the back of the restaurant and got on his phone, he left work like ten minutes later .. we called the owner and He fired him that night.. I've heard that the guys in the back are perverted but I never truly believed it because it was all here say from past workers who I had never met.. They have never disrespected me before and I talk to them more than any other waitress because I am billingual.. The guy who got fired is over 50 and had always been kind to me.. I called the police and made a report because who knows if this isnt the first time and I need to make sure no images of me are on his phone.. Ive worked shifts alone with only the bartender whose to say it didnt happen before because 95% of the time im wearing a skirt.
So this is it, he is fired however the guys in he back are either not talking to me or saying very little with the expection of 2 guys.. the guy who got fired had been working there the longest, so now i'm working in this very uncomfortable environment around guys who are acting strange around me and I feel uncomfortable and awkward because I don't trust any of them anymore. I dont go back there to get my food all the time because i'm uncomfortable especially when i'm wearing a skirt. I'm at a breaking point to where I just want to quit or give my 2 weeks because it too much to take, its getting to the point where i just dont feel safe.
I'm a student I work like 30 hours a week there but I only work all day friday (10:30 -either 9 p.m. or 4 a.m, depends if i close or not) and i work sat night ... i cant find a job anywhere that can accommodate to my needs as a student simply because those are the best nights to work and the more experienced workers have those shifts..
So my question is could I apply for unemployment as a part time worker under my circumstances??
or am I just out of luck and either have to continue to work in this environment or quit.
IF ANY CAN HELP PLEASE HELP ME WITH ANY INFORMATION!!!!
The big problem is gone. It's a management axiom that sometimes you have to make an example out of one, to show the others. You stood up for yourself and management backed you up. The others may resent you for a while, but that'll be all it will ever be. It will blow over.

I don't see how you have any recourse. The guy did something criminal, you complained and he was fired. Management did their job. There is no requirement that your co-workers like you or speak to you unless it involves getting work done. There may very well be some bitterness that their buddy was fired, but they are also probably figuring the safest way to keep their job is to not have anything to do with you.
