I have been ill for a couple of years. Just about all documented by notes, evidence. I am always on the border of being fired. Getting written up for excessive use of sick time. Now it is crunch time. I was told two weeks age when I had a fender bender on my way to work that this is the last time they will except any reason for callouts. Unfortunately, we were on vacation 350 miles away when my husband became ill and wound up in a hospital overnight. The day he was released, I should have been back to work at 3pm. Regrettably, we were discharged at 9 am and we're still facing 9 hours of driving. I called out and was told this would be an "occurrence" and I could look forward to hearing fro HR on Monday in regards to termination. Also told that my absences would prohibit me from receiving UC. By the way, I did reduce my status in March from full time to part time because of all the health issues I have now and in the past. Thank you for a reply. Ann

Pennsylvania is an At Will State. I'd look that up so you have a better understanding about where you stand.

looks like they've documented your absences, given you notification in advance about lateness, and HR is involved and scheduling a hearing.

You will probably lose your job here and their case seems bulletproof. They also have grounds to deny your unemployment should you file. Sorry OP. Get those resumes out there.

Try to find a smaller company to work for. They are generally more family friendly and usually a little more flexible when it comes to sick time.

That may not be true as long as she has Dr's notes for her absences. Unemployment is not usually denied if one was deemed "unable" to do the job.

The last two were not illness related- at least not for her and she was warned and documented. being "unable" to do the job wouldn't apply to a broken down car, or a spouse's illness extending a vacation.

we've fought and won denial of benefits for similar situations here on identical grounds. It looks like whoever that employer is, is running a very tight ship.

Perhaps you should consider getting Disability if you are always that sick and can't get to work on time everyday.

It's not your employer's fault; it all sounds like a bunch of excuses to them. Sick, fender bender, husband sick, etc.

Sounds like a legit reason for termination to me. If you cannot do the job, for whatever reason, you can be terminated. The only protection you have is FMLA leave. Once that runs out, any further absence, even if you are PT or have available sick leave, is grounds for termination

It does sound like the company is prepared to terminate you but do not take their word for it that you can't get unemployment. PA is a fairly lenient state when it comes to UE, so certainly apply and follow the appeals process if the employer fights it.
