I have a friend...

She works in a non union business of more than 500 employees.
She has 16 years of seniority.
There are 2 positions, supervisor or cashier.

Seniority dictates favorable days off, hours distributed, overtime, hours.

So they hire a man, off the street. He is a cashier, hired as cashier, gets paid like a cashier. But he is given weekends off, for his hard work, and given favorable hours because he is a strong man. Senority is put aside to make this guy happy. He is used for stock, but works the same when not doing stock.

She has notifies her manager and HR of this unfair practice. She has held the same position, and worked for weekenda off. She has earned it, but it is stripped away, as extra incentive , to give to the stock guy.

The stock guy, with weekends of , less senior to a large number of supervisor, was groomed for and given a management position, passing up the all female supervisory staff. His position did not have an open position listed. The job wqs given.

I tell her, they are discriminating because he is a man. When he is on vacation, he schedule is replaced with another male co worker, less senior as well.

If the men are not around, stock is handled by the supervisor and other cashiers.

Tell me what this clearly looks like. What federal or local goverment agency can she turn to. She has complained, and recieves retaliation when she does.

She has repeatedly requested for a piece of the weekend, but has been denied. She is even bumped by new seasonal employees. She was even cut hours during slow periods, while all the supervisor that work mornings, with weekends off, still get a full work weak, including the less senior stock guy.

Poor lady getting screwed!

This is the entitlement concept and cancer of people in our nation now.


You are not entitled to any position, especially NON Union.


Those that are hiring, can or should be able to hire whoever they want for the position. They are the one's that will have to pay for their incompetencies

also men and women are not equal physically. There are qualifications of the job that you have to be able to life ___ lbs.


Why should other people have to pull this girl's weight so she can get a promotion?

she is in ny

when you have a non union company, but have a company policy regarding seniority, and sex discrimination laws on the books, what does one have to do to get treated fairly.

it is not a promotion, it is preferred days off, because of seniority. Seniority dictates a preference of shifts and days off.

every one hired has the same job qualifications, lift x amount of pounds, stand all day, stock items, etc. BUt since the men get special perks, like days off, and better hours, only because he is a man with muscles, is wrong, wrong, wrong, sex discrimination at its fines.

women work in non traditional roles, like a cop or fire man, Im sure they are entitled to fair pay and privileges. The same as women in CEO or other management position, they deserve the same opportunities and perks for working those long years. How about driving a cab, because they are women, they dont deserve to earn the same living and have the same happiness as a man?


what kills me the most, her Manager is a woman as well, but cant see the harm she is doing.

Its like telling a man he cant do make up, of blow dry hair. he is not entitled to a fair ahke as well?

This lady was not nor desire a managrment position, it just the atmosphere of having other tenured women supervisors completely overlooked by a newby male, with out a posted opening.

It was not a promotion, but job given to a male. This man also dated the managers daughter, and lived in her home.

When an employer gives out the rules and regulations, via a handbook, they should follow the rules they create.

They have a written seniority policy? In today's world, I doubt that would be in writing.

If the employer is a Fed contractor and this is a pattern (more than one employee impacted) contact OFCCP and ask for an audit of the Affirmative Action Plan for that facility. Suggest that they look at (whatever is the issue). If the employer contracts with state or municipal government they may have similar audit authority.

in writing,

senior employees in their position, starts at date of hire. seniority rules in preferred days off and hours.
they wont bump some one in their position or hours, if an employee is locked in a shift or days off.
Overtime gets distributed to senior employees first.

so , she has over 12 years in, and here comes joe schmo, fresh meat on the team, getting those weekend days off, because he is a man with strength. all are hired and coded as cashiers. this is the only perk you work for. it should be respected.

that male also jumps others in seniority, but they just go along with the lies.
