i was working as a general manager in a single person company, coz of the delay in paying me my comission for the last two years i submitted my resignation to them and asked about my rights, the owner mentioned that he will arrange the payment, later i was sending him an e-mails asking about my rights he start telling me that i m bothering him and he don t have money now to pay me, so i take the case to ministry of labour and register a complian after one month and twinty days from my resignation, he attended the meeting and declare about my rights but after a week he file a case against me saying that i was spying the staff e-mails , i deny about what he mentioned and now the case gone to the courts. Q. what is my situation in this case, do you think that i m guilty coz of observing some of the suspected staff under me coz they are using the company property illegaly ? please provide me you leagal opinion

Sorry - I think something has gotten lost in translation here - If it was a single person company there would be no staff or employees under you

From what I understand, rules in the UK for personal privacy are different from other countries. Here you are not allowed to use spyware to observe what your employees are doing on company computers (whereas in Canada, for example, you can do so as long as they are made aware of surveillance).

Just guessing that you're not in the US? You certainly don't have a good command of the English language and in the US we don't have Ministers of Labors. Best to consult an attorney/legal advisor/barrister in your local jurisdiction. Cheers!

I assume by single person company you mean that the company was owned by a single person?

And was this the UK? I realize you're posting on the UK forum but that don't necessarily mean anything. Frankly if so, you should contact (at the very least) the Citizen's Advice Bureau - this sort of question is well outside the remit of this forum, even if we understand the question (which I'm not sure I do).

However - no you cannot spy on employees email without having consent. For example: Welsh college rapped for spying on employees' Net usage | News | PC Pro
