Did the tenant start off moving in with a full fuel tank supplied by you or did the fuel in fact belong to the tenant?

Well, homeowners insurance probably would have covered the damage if the house was insured. The trouble is that when I first bought the house it was in terrible condition and insurance companies wouldn't insure it. By the time I had everything fixed up I spent all my money and I couldn't afford insurance coverage, much as I wanted it.

It was the tenant's responsibility to pay for oil. When he moved in I gave him about 50 gallons in the tank. I guess it was kind of his own oil he drained out of the tank, but either way the lease stated that he was responsible for damages caused by the house freezing.

It depends on your management company and the agreement that you have with them. Do you have an eviction protection plan in your agreement with your management company? If so they should be able to handle the legal aspect for you but it will probably cost you some money to get it started. If not, I would recommend going to the courts, getting the insurance company to come out and look at the damage and the proceed with legal action ASAP. If he's not around for the court case it will be fairly easy to win. You may also want to talk to the courts about locating him and garnishing his wages if you win.
