I was in an accident about a month ago. The other person sped out of their parking spot and backed into my car. I filed a claim with my insurance and the other insurance company contacted me as well. After talking to my witnesses, the other driver was rightfully found at fault. The other insurance company sent me a $1,000.00 check for the deductible. When I went to pick up my car, they told me the deductible and anything over it was waived (paid for) so I didn't end up paying anything out of pocket. My rental car was also paid for. My insurance company said my claim is closed and when I called today, they said the other insurance company had called about a week after the initial conversation to say that they are declaring me at fault. My insurance company said it's nothing to really worry about but it may take a while for them to resolve. She also told me that my rates wouldn't go up and when I asked if I should be receiving anything from their insurance company or does their insurance pay them directly, and she said they will get paid directly.






My question is, is this $1,000.00 mine? Like a payout or something?

You have a legal question. One that will not very well be answered here or on any other forum site. Did you tell your ins company about the check? If not, do so and ask them what you should do about it.

Personally, I'd hang on to it until all the dust has settled.
