In Texas anytime that a minor is involved in a auto accident depending upon judgment from the judge and courts usually an attorney is hired to set up a trust for the kid until he/she turns 18. I wanted to know if at the time of a settlement being reached from the injured they RELOCATE to another state how that works. Does anyone know if GA is set up the same.

You can Google for this FYI. Try different key words--not certain at this moment of what to suggest. Been a while since I worked in that field.

I guess this would be civil litigation--or perhaps estate/wills?

GA Bar Association might be a place to start--they do referrals and I believe there is a fee when you contact an attorney.

GA Legal Aid might be another resource.

I am certain there are others in this forum with greater expertise in legal matters. LOL--they may be around later in the week --I imagine the poster you need is 'Plessthanpointfive'--she seems to know a good bit about a variety of things and is one of the most helpful people I have met IRL or online.

Your life sounds something like mine--so here's a cyber hug (((Lashonda))).

One thing about Atlanta---no shortage of attorneys. I understand them but at times agree with Shakespeare--'First thing, we kill the attorneys...' That man had some pretty good insights concerning the human condition. English Law--no wonder they had so many taverns. jmo.

For questions like this, I'd use Yahoo Answers. Lots of experts go on there to answer questions. Personally, I go on there to answer questions in my field (computers) from time-to-time, and also math, science, and spiritual philosophy / metaphysics (of a non-religious nature). Usually when I ask questions, it's about taxes, legal, or real estate :-)

It's hard to understand what you are asking.

In general terms, the laws of the state where the accident occurred are going to apply to a negligence judgment. It doesn't matter where the parties live. A settlement, on the other hand, being a voluntary contract, could specify the state whose laws will govern construction and enforcement.

However: If suit has been filed in Texas and a minor is involved, Texas law might require the court to approve the settlement, and the judge could refuse to allow a provision to apply another state's law to it. Assuming that Texas law requires a trust to protect the minor's settlement proceeds from parents and/or teenage stupidity, the court would have a compelling policy reason not to let the parties circumvent the trust requirement.

Thanks !! that was what I was asking if the rules would be different being the accident occurred in Texas(which again with judges approval /determination) decide whether a trust fund (depending on the amount of the settlement for the minor) should be set up if at the time of settling I transfer into a nother state that does not abide by that law (not sure if GA does ) but a lot laws in Texas are different.... Thanks for your help
