Seeing that it's a BMW (junk), duct tape over the CEL is probably the only way to fix it. LOL
So many in this thread and on this site seem to be this uninformed.
My last BMW 7 series cost me $1500 over 5 years in repairs and maintenance. My current '01 7 series, bought for $7500 at 150k miles, has had zero cost in repairs in the year I've had it so far. The 5 series mentioned in the OP is a strong, fairly high quality car overall, that is easy to DIY and has a fairly low cost of parts and repairs (especially if it's the 6 cyl version).
Of course, were I to buy one, I'd do my own inspection as I know what to look for and always carry an OBDII reader to make sure it's not got hidden issues.
Not a single person here is defending the dealer. The issue is the buyer did not have the car checked before he bought it. When starting up the car, he should have noticed that the check engine light was not illuminating. That would be a huge red flag. Issue #2 is the buyer not having the car checked out by any one before they bought it. You can't assume that just because a dealer is selling it that the car is free from defects. This dealer IS a scum bag, and has a very shady past. However the buyer did not do his homework before they bought the car.

Because they have never owned one. My BMW's have all been the best cars I have owned. In fact, recently I did an online smog check for my old 2001 330 and saw that it was still on the road as of late last year!

Yep. I wonder sometimes how my old 2001 325 that I sold couple of years ago is doing. It was still a way way better car than any 10 year newer rentals I had - toyota, hyundai, honda, kia, whatever.
