We have an unpermitted converted garage unit rented to a family of three. The City of San Jose sent notice that the tenants living in the unpermitted garage unit have to be vacated by Oct 31th 2013. However, the tenants living in there refused to take the our relocation benefit (all the rent they paid since they lived there - three months) plus security deposit and rental free on Oct, and they has no intention to move out. They hired a lawyer threatening to file a law suit for some nonsense reasons and their lawyer told us his purpose is to get the unknown figure of settlement and will take our hour and ruin our finacials.
We would like to know What is the legally required amount of the relocation benefits to evict the tenants in the illegal apartment unit in San Jose California? Do the tenants living in the unpermitted converted garage unit still legally consider a tenant of ours after Oct 31, 2013 when was the last day set by the City that the tenants in the unpermitted garage has to be vacated? Do they still protected by the landlord-tenant law after Oct 31, 2013?

You need to talk to an eviction attorney as soon as possible. Look up local attorneys who specialize in evictions, call some of them and explain your situation, and they will be able to help you. This will likely not be cheap for you. Yes, these people are still technically your tenants until they move out (whether by their choice or by court order).
