No. you cannot just shoot them for attempting to break in the house.
However....... If the suspect was trying to kick in the door, then the law allows you to shoot through the door thus eliminating the threat.
Also, if he were to have gotten the door open with that crow bar, and then proceeded to advance towards the homeowner with crow bar in hand, then the homeowner could perceive the crow bar as a deadly weapon-which it is- and have shot him; as long as they were within 7 yards of each other.

So now the Mecklenburg County DA has dropped all charges against all 3 suspects!!

They dropped charges against the original suspect, because, well, he wasn't the right suspect even tho they ignored all evidence to the contrary and were determined to pin it on him anyway.

But when they finally figured out who the two bad guys actually were, they got a little too enthusiastic and searched their apartment without a warrant, so the DA is throwing everything out!

I always try to support the police because I truly believe they do their best and have a very difficult job.... but this time, they just totally blew it!

Fortunately, the pair that seems to be the ones responsible for several break-ins while driving a red jeep cherokee still face felony charges in Concord. Hopefully the Concord PD will follow the book and get a conviction.

The unreal just keeps on coming. In a contest of stupidity, these perps have won!! Wouldn't you think after getting off on a technicality they would lay low for a while? No!! Same 2 numskulls arrested Monday in SC on same charges, same mo, even using their red Jeep Cherokee. This time hopefully the charges will stick.

(I thought this front page Observer story was a rehash of old news, but the "new" part is the arrest Monday in SC)
