If your are using someone's likeness, you have to have their permission, unless that person has reached a certain level of "fame." For instance, a newspaper doesn't have to get Obama's permission to print his paper, but they would need my permission to print my picture.

Like all legal things, it's legal til someone raises a fuss You cannot make money off of someone's image, but actually getting government clearance to remove anything from a website is nothing short of a miracle.

They don't if it's newsworthy and your picture was taken in a public place.

They're also not making money off these pictures, or if they are, it's de minimus. The persons in this picture are in a public place with no expectation of privacy, so they have very little grounds for action.
