Major difference between the North and the South. Down here we would have had a parade for the guy. Then again, the guy wouldn't have used a tire iron on the scumbag. He'd have just unloaded his gun on him. Kindly remember folks, these folks arresting him are also in charge of your voting rights.
Sounds like he went too far. You can't do what he did.
But with the emotions he must have been going through, could he be held criminally responsible?
Weird one. Not sure theres a right or wrong way to go about this one. I have no clue.
Do you have a wife?
If I ran into someone immediately after he had (or tried to) RAPE my wife, I'd likely do the same, if not worse (torture him as much as possible.) Emotions take over when someone you love dearly is hurt.
If all is true this should be one of those cases that deep down the justice system knows he'll walk free but they only require him to go through this process because if you don't it leads people to believe they can always do something like this. Not saying I am against what he did but it could open up a very gray area as to what somebody is really doing. Somebody could see a struggle in an apartment and automatically jump to conclusions if they know that things like this are easily dismissed.

If he has a practical judge preceding over his case, s/he will take this into consideration when s/he makes a judgment.

I do understand what you are saying.
I think the key here is whether or not there was intent to kill him or stop him for the police to arrive. Sort of like the store owner who shot a robber, then a few minutes later unloaded the rest of the bullets into him. He went to jail for excessive force.
Here, unless he bashed away 15 or 20 times I would think he will get, at worst, probation.
......Ever happens to me, I'm just taking the body outside of town and feeding it to the alligators.
