Regretfully the beating that caused the perps death took place outside of the apartment. My father and I called the cops once because of an attempted break in. The cops said make sure that he falls inside of the house. Garages that are part of your house count also. Detached garages don't.

A cop has the right to shoot the perp at the moment of expected penetration. I think that I read this in the New York State penal law book.

In my world, this would go to court, the judge would be given ALL the evidence, the plaintiff's long list of priors read off for the record, 80 percent of plaintiff family lawyer Schwartz's pay for handling this case would be given to the victim of the initiating criminal act, Mrs. Diallo.

The judge / jury should find the defendant use of force appropriate for the crime and a commendation to Mr Diallo for ridding society of a known predator.

The courtroom audience response...

The legal logic doesn't make sense, that the perp wasn't a danger anymore, and could therefore not be attacked anymore. He just committed a violent crime, and was faced with an angry husband. How could he not be a danger? He was desperate. If he had a gun, he would have pulled it out and shot the husband. That's dangerous. If he could knock the husband unconsious, he would. That's dangerous. The husband had to try to subdue him as fast as possible, because of the risk that the perp, in trying to escape, would kill the husband. The husband had no weapon good enough to intimidate the perp into surrendering. Therefore it was automatically a fight to the death. A fight started by the perp when he committed the crime. By what possible legal logic could anyone possibly construe that as being an attack by the husband against someone who is not a danger?

It's the liberal justice system. You can't be trusted with a gun, knife or a whistle. If you are attacked and your wife is almost raped, you must allow the rape and pay the man on his way out instead of protecting your family, lest you be arrested for it. 'Merica, where we have 5% of the worlds population, and 25% of the worlds inmates....
