There are two different aspects of business names. Registering and trademarking. One does not need to trademark a name, but can. However the process can take months and costs money. I'm not certain, but there could be an 'annual upkeep' fee involved to retain the trademark.
Usually with business names, people (small businesses) take the simple route. All one does is register with the Secretary of State. You can use a name that someone else already has, just as long as it is in a different state, two different businesses in the same state cannot have the same name. Depending on the state, names must be very different OR, some states are a bit more relaxed, one simple difference, such as a hyphen is acceptable.
