His posture reminds me of an Australian shepherd - the herding look I guess.

I didn't think of Border Collie before...Now I'm off to look up some pictures..

Doesn't matter what he is though, Duke is an awesome guy..He is getting along with Cole, our Schnauzer mix. They play pretty hard, so we have to make sure they are playing nicely..Cole is only half of Duke's size.

Here is one more pic of the two of them..

Default memories of our Goldie

she could be a mix of any of these G.Retrvr, Border Collie, Chesapeak Bay Retrvr. All in all I see mostly a bird dog confirmation mayby some sheep dog like qualities.

Goldie was a Shephard G. Lab mix. (she is the bigger of the two )
Guess the breed-goldie-shauri.jpg

Gretchen was a Shepard, collie, setter mix.

Guess the breed-grutchen.jpg

Maybe part sheltie. If he's part golden and only 40 pounds, he has to have some smaller breed in him.

I agree that he does look like a Nova Scotia Duck-Tolling Retriever. We use to run into a lady with two of them and people use to ask her if they were small Goldens and she would get sooooo upset. She seemed to feel everyone should know what her dogs were despite them being rather rare in this area.
