Color me deluded, then, Ken, at least on the first score.

Donofrio had a reasonable interpretation of the Constitution and not one that, historically, was uncommon.

To me, it looked as if the preponderance of the evidence went towards Obama's being a natural born citizen, but it was not a slam dunk case.

What made it a slam dunk case that Thomas should never have even pushed to Conference was that the case, ultimately, could never be seen on that part of the claim, because it was tied up in the claim that the Secretary of State for NJ had not done her job.

As with the other states in which this route is being taken, the threshold for "doing the job" is very low, making it hard to get the case out of the state's Supreme Courts with a win, and therefore making a reversal with the SCOTUS nigh unto impossible.

There is one Federal case out there that I could see having a shot, depending on how it is written, and that's because it is a class action suit, which might get around the 'standing' issue.

I suppose I should check to see what that one is up to. The rest of them are dead in the water, even if they and their supporters can't see it yet. More's the pity, in some ways, as it would be nice to have gotten a definitive ruling on the actual question, to go with the clearly written opinion of the DoJ, back in 1995.
