Automatic weapons are illegal in Spain period. Private possession of semi automatic assault weapons is only allowed special permission. This has been the law since 1991.
So yes hunting with a AK would get you arrested since it's outright illegal. So likely these dumbasses were not legal Spanish gun owners.
You aren't allowed to have antique machine guns unless you have a special permit for them.
I hate to break it to you but it is a myth that self defense in the UK will get you in jail. The cases where someone went to jail for killing or harming a burglar were because they did things like set the burglar on fire when the burglar had been tied up in a chair or used an illegal weapon to do it. Self defense is legal in the UK for homeowners. It's not legal when you do things like attack the burglar after they have been detained or use illegal means. In the US shooting the burglar after he was on the ground or tied up would also you get you in jail for murder.
As for a trap in your house or property in the US that would also get you in jail. Man traps have been illegal for decades in the US.
Spain btw is the 18th most armed county out of 178 countries. Over 2 and a half million people are registered gun owners in Spain. The law btw allows registered gun owners to openly carry firearms.
It should be noted that in 2010 there were 390 homicides of which 67 were committed with a firearm. And usually about 2 dozens or so suicides by gun every year. Compare that to the US where every day two or three times that number commit suicide by firearms.
Thanks for the answer.
So UK's legal system works better than the Spanish... no surprise there.
But I have a doubt. If armed criminals enter your house and you defend your familiy with an illegal weapon, you'll be charged with murder?
Spain appears so high in the list because hunting is quite popular here, and most of those weapons are shotguns.
Where did you get those statistics, because I think suicide statistics weren't published in Spain in 2010 (INE).

The possession of automatic weapons in Spain is severely restricted.
But those thugs were carrying knives, not firearms. They weren really Spaniards, they have the Spanish nationality, itś increadibly easy to get the Spanish nationality, no matter if they entered illegally or anything else.
The massmedia here quickly tries to cover the real truth, that they were immigrants, saying "two spanish citizens".
I think you can have some of those antique weapons here with firearms type F.

They were indeed legal gun owners. Most people I know own old weapons, but most don't work, just part of an inheritance. To be legal, the Guardia Civil has to spike them. There's a flourishing black market, after all former Yugoslavia is not far.
I doubt it makes a differences whether you use an illegal or legal weapon to defend yourself. The usage of an illegal weapon can lead to a conviction after the first trial, though. Which is fair in my opinion. Why shouldn't you be fined/imprisoned for owning an illegal weapon?
If you kill a person, you'll be charged in any Western European country. It's up to the court to decide whether that action was justified or if there is a valid excuse.
A few years ago, we had a drink at the famous Plaza Santa Ana in Madrid. Suddenly there was some kind of an uproar as two police officers were chasing a kid, with his hear in cockscomb style, stained bright orange. You know that kind of new wave kids.
Once aprehended, the kid was beaten severely, blood everywhere.
What upset us the most was that one of the arresting officers, a testosteronimo in his twenties, turned to the public and schouted out loud: "well at least this one won't have a hard one, the next couple of days!".
We were disgusted. We left the place and the day after, we left Spain, never to return again, untill Spain really complies to the European Treaty on Human rights. We didn't return yet.
So perhaps you're right: perhaps human rights are better looked after by individuals acting in self defence. But I doubt it.
I think the US has a better and more rational self defence law.
Depends where you are in the US. In California if a burglar breaks into your home and injures themselves, the homeowner can be sued. Now as far as self defense in cases like this, generally yes although some states are better than others.
