Prosecutors opt not to pursue charges in apparent road rage attack on elderly driver

https://www.hawaiinewsnow.com/2022/0...e-attack-laie/

Why HPD and prosecutors decided not to charge 28 yo Daniel Reid Aikau? Any insider info? Is this level of corruption normal for Hawaii? What about Aloha and respect of elders?

Is the young guy part of some connected family?

I wonder if the daughter of the old guy can sue in civil court since the local justice system failed so miserably.

You can sue in civil court. If you don’t have an arrest and conviction it gets more challenging but video helps.

QUOTE FROM ARTICLE: In a statement, the city Prosecutor’s Office said it worked “closely with HPD on this matter and decided that there wasn’t enough evidence to prove the case beyond a reasonable doubt.”

Not enough evidence? That video is all that is needed for evidence. Gotta be a payoff. A-hole should be locked up!

I wonder if case can be made against prosecutor's office. Any lawyers on this forum care to comment?

Almost certainly not. Prosecutors have a lot of discretion in terms of whether to pursue charges in a case. Absent a prosecutor breaking the law or legal ethics in making/not making certain decisions, there's not much that folks can do.

And as egregious as this case is, the decision not to bring charges at a base level doesn't seem to implicate any the prosecutor in any wrongdoing. Note, it won't shock me if there's a federal indictment against Alm and others in his office a few years from now for some pay to play matter involving this case But that's just me thinking out loud based on other misconduct by prior prosecutors in the area

It might not be over quite yet.

"..On Sunday, Hawaii News Now followed up with the office for further explanation. In a statement Matt Dvonch of the Honolulu Prosecutor’s Office said, “The case remains under active investigation and we are hopeful that as we review the existing evidence, as well as additional evidence that may be uncovered as the investigation continues, charges can be filed.”

Seems that the prosecutor's office forced itself to say something merely plausible to the public. However, if I read correctly between the lines, this exact comment from the prosecutor's office means that they won't charge and they moved on.
