The city has agreed to pay more than $321,000 to settle a lawsuit filed by a woman who tripped and fell on a sidewalk.

Ellen Wall was visiting Hawaii with her husband in 2005.

She was walking along Kapiolani Boulevard in Mccully when she tripped and fell.

According to the lawsuit, Wall lost the use of her right eye as a result of the fall.

She has since undergone 9 surgeries, all of which failed to restore her eyesight.

The lawsuit alleged the city failed to properly inspect and maintain its sidewalks.

I must agree with Brav989 ... I would be willing to trade off somethings or give up some conveniences, but I don't think any body parts would be included in any trade-offs to live anywhere.

2005-2009 - 4 years went by with the law firm getting about half of the settlement.... Not worth it!

I am sad that the woman got hurt....

I really don't know the conditions of the side walk, so I can't say... trees usually up root side walks.. shift in the ground... many reasons could be blamed for the condition of the side walk.

I remebr a long time ago someone drowned... yes sad... but, the managed to sue the state.. to what extent. does one accept their own responsibility?? I ma shure if I went swimming I would atleast know how to swim... or when walking on the side walk I would lift my feet...

enter at your own risk... proceed with caution.. what does it take??

It always amazed me that when ever bad things happen to us we automatically want to assign fault. Why is it that we can not accept that bad things might happen and that no one is at fault. How is it possible that a city can ensure that you will not trip and fall on its sidewalks....I also want to remind that for those of us that live in Hawaii...we have all now paid (through our taxes) for that unfortunate lady's fall.
