Is this correct?

As of March 1st houston Texas will no longer be arresting people for small amounts of marijuana. This is due to a change in the law by the Houston city council. The new law states that anyone caught with four ounces or less will be issued a citation and fined up to $250, but will not be taken into custody. This change comes as a result of the recently passed Texas HB 2165

Not true at all. Possession is still a State law violation. Under 2 ounces is a Class B Misdemeanor, 2 to 4 ounces is a Class A Misdemeanor. That means enforcement is up to the Harris County DA, who hasn't been prosecuting under 4 ounce cases, but will allow offenders to go into a diversion program. HB2165 has nothing to do with pot.

In any event, you can still be prosecuted. Montgomery County WILL prosecute the small amounts. Their DA is a hard case.

Yeah. Harris County hasnt wasted their time with low to moderate levels of pot in ages.

Let's say someone gets pulled over. And the cop smells weed. And all this person has is 3Grams and a grinder.

Let's say this person lives in spring branch.

Will it depend on the cop?

What about driving under the influence?
Could depend on where in Spring Branch. I bet Spring Valley might make a bigger deal of it than HPD.

If the cop cared to search, then they'll take the weed and smoke it themselves but let you keep the grinder (seen it happen). Maybe give a ticket if they're having a bad day.

Doubt it. Not like Spring Branch can change the county it is in.

I wish they all get prosecuted. At least get beaten with a stick at a public square like in Saudi Arabia. Oh unfortunately this is not Saudi Arabia...

You laugh, but they literally had no crime there when I was assigned there. It was standard practice when you had to pickup an item or two, not only to leave the car doors unlocked but also the engine running with the keys in it.

The US could take some lessons, our neighborhoods might soon be war zones in this lax justice environment.
