Our laws seem to always contradict each other. There is also the law that if you are a public figure (which we all are if we are out) that anyone can photograph you and print it with or without your permission (think of the photos out of celebs). I was taking a photography course and took pictures at the Kemah Boardwalk -- those dancing fountains the kids play in because they make for great action photos in a public setting -- plus kids are just great subjects. So had someone accused me of something like that, I would have found it appalling plus overly uptight. Public is public. Now getting kids to pose (and what sort of poses and what sort of dress might be telltale of the purpose) is a different matter.

WHAT? This is ridiculous. How do they know this guy is using these pictures for sexual purposes? Even if he is, WHO CARES? These are people in public places anyway, and you can clearly see what you're taking a picture of with your own eyes. If you want sexual gratification you can get it by just looking at them. What are they going to do? Arrest the people who stare, too?

No, leave me alone, haha. You don't even know me. I'm not going to get into a internet debate over something so ridiculous. If they do have proof that the guys photos are indecent then he will go to court. But, what I was referring to was the OP's question. If they are arresting anyone for just taking pictures then that is a huge problem.

Let's chew on this - let's say this was a high school girls soccer game. Having covered high school sports at newspapers I can say that no releases or waivers are signed before the teams take the field, and that pictures end up in the newspaper and elsewhere. The newspaper is a commercial entity. I suppose being in the arena of athletic competition with spectators provides enough expectation that you are likely to be photographed and it may end up published by a media outlet?

Now if somebody reading the paper has a thing for soccer girls, then what?

Like I said, I don't know what this guy was up to. I suppose it's as much within the realm of possibility that he just doesn't know how to operate a digital camera and that's why heads were cut off, as he was looking for pictures of teenage soccer girls for the purposes of getting off.

Maybe he should've told them he worked for the paper. I used to have people blowing up my phone line and email wanting me to put their kid in print for playing little league baseball or whatever.
