The article said that this man's visa was to expire on Jan. 18th and it also says that his mother is in this country illegally. I guess some people don't read the articles and just assume. So yes you are right, it is an illegal immigration issue at least for his mother.

Untrue. The mother's status is actually unknown. There is at least one court paper that says she entered the US in October at Las Vegas. The problem is the immigration people do not show her entry. (Happens all the time)

The record shows she last entered in 2007 but it also shows her departure from that trip.

I doubt very much the mother snuck in. So likely a missing entry notation. She could be illegal if it was a while ago but most likely not if the Oct entry is true.
