City Alarmed by Police Impounding Cars of Undocumented Immigrants. Category: News Updates from The Berkeley Daily Planet - Thursday February 19, 2009

“But it’s unconstitutional to take someone’s property away solely because he doesn’t have a license—it’s not enough reason to justify a seizure.”
My goodness, the idiocy that I have to endure.

Berkeley is amazing. The concept of someone driving while in the country illegally and thus not having a license is remarkable.

If there is a legal U.S. resident who owns the vehicle and loaned it inappropriately; they should be liable for the fees to regain their vehicle and be sternly warned not to loan their vehicle to people who are not legally licensed. Their insurance company should also be notified of this problem and the vehicle should not be released until valid motor vehicle insurance is proven.

I believe these contingencies would make most of these vehicles property of the government (and properly so). This will not even start to pay for the damage unlicensed drivers with no insurance perpetrate on the CA popluation.

Remember, this is the same city that ordered the fire trucks to remove the American flag so as not to offend someone. This was the fire fighters way of showing support to the firefighters who died in 9/11. This is also the same city that opposed the invasion of Afghanistan after 9/11. This is also the same city that told a Marine Recruiting office that they were unwanted and unwelcomed intruders in their city and they sought help from their lawyer on how they could evict the Marines from their city. This is the same city in which the university had no problem with students burning an American flag in protest but wanted to punish conservative students who wanted to do the same to the flags of terrorist supporting nations and groups. Boycott the entire Bay area,...especially Berkeley.

I used to enjoy visiting Berkeley 30 years ago; in all fairness, it was not as extreme in the idiocy department back then either.

The thing about firefighters not being allowed to fly Old Glory really pissed me off---------and, I am somewhat of a Hippie at heart myself.

As for the rest of the Bay Area: it needs a 1930's style economic crash to bring it back down to earth. The disconnect between housing prices and 'normal' peoples' wages are disgusting, to be polite.

The mayor has been continuously opposed to the state law which says that immigration status is required to get a driver’s license,” she said. “But we don’t know what local law you could pass that would supersede the state law, except for someone actually changing the state law.”
Oh my................and they wonder why the state and the nation is running on fumes.

Such fuzzy headed thinking.

If they did that here in San Diego the Police would have a budget surplus just off the auctioned vehicles.

Oh brother. So why wouldn't an illegal aliens vehicle be seized? No license, no insurance - it happened to my BIL why wouldn't it happen to illegal aliens? Seize their vehicle and put them on the bus to be deported.

“People are obviously upset,” Arreguin said, adding that he couldn’t understand how the police could do this in Berkeley, a city of refuge for illegal immigrants. “This is a big issue and not in the best interest of the city. It’s been going on for a long time and the city has not been doing anything about it. It raises important legal questions and whether we are discriminating against one group of people.”
Quote:
Julie Sinai, chief of staff to Mayor Tom Bates, said that although the mayor was aware of the issue and sympathized with the immigrants, there was little that could be done since state law authorized the police to tow and impound vehicles for 30 days when driven by drivers who were unlicensed, or who had suspended or revoked licenses.
Quote:
Silverman said that although state law allowed the police to tow a car when the driver did not possess a license, it was unconstitutional and went against the individual’s Fourth Amendment rights.

This is utterly absurd. How are they discriminating against “one group” when the law requires the impoundment of vehicles of ALL unlicensed drivers, or those with a suspended or revoked license?

Why is it ok to impound vehicles belonging to legal residents, but it’s somehow ‘unconstitutional’ when an illegal alien has a car impounded? Should we simply have a free-for-all, and allow anyone to operate a vehicle? Why have ANY laws, if a select group can violate them with impunity? I guess next they’ll complain if they receive a ticket for parking in a handicap space without the required placard.

They have become so accustomed to thumbing their noses at ALL of our laws, that they actually believe none of them are applicable to them. When will this idiotic IA pandering end?

Benicar; like you, I am perplexed (at best) as well..............

Although: when Berkeley's source of income is cut off; be it by either Federal gov't fiat, the overall economy collapsing, etc.------------methinks attitudes in that town will do a 180 degree turn.

There really is a double standard. Here illegals aren't required to have drivers licenses or liability insurance. Nothing is done about them, but the tickets given to American drivers are insane. Americans most buy costly insurance, but half the drivers on the roads here don't have it.
