I read lots of comments at you link about how this or that may not be used in this case or that case, and using age as a determining factor is not permitted if the applicant is over 40.

Didn't notice anything that said it was illegal to ask. In fact, because age discrimination does not kick in until age 40, the employer would be forced to ask in order to determine if he was within the law. Age 39 can be too old; age 40 age cannot be considered.

You're not being confrontational. You're asking for clarification. If I were asked if I could swim, I'd be concerned that swimming might be an expected part of my job duties. I'd certainly like to know that.

It is pretty easy to extrapolate your age by asking a few basic questions .. Asking age is generally seen as a no-no unless age is a legal job requirement.

Are you a HS graduate?
Did you attend college?
Did you graduate? Is so, what degree did you receive?
Work experience ...
