Hey guys, I have a dilemma, I have a roommate with a signed lease that is month to month. He hasn't paid me since December meaning he owes for Jan and Feb rent. I was wondering what the fastest and cheapest way to evict him would be? He's refusing to pay rent and the late fees and I gave him the option to pay the rent owed and not the late fees and take a 30 day notice or I'm going to the constable. He's refused to pay anything so I guess its off to the constable unless ya'll know of an easier/cheaper way. I've never been through the whole process but it looks awefully complicated. Thanks in advance for your help!

Not really sure the specifics of evicting a roommate, but in a normal evicition you would post a 5 day pay or quit and then after 5 days (not including weekends or holidays) you can file a 5 day unlawful detainer (I believe this needs to be served, not 100% sure tho) and then after those 5 days you can file for an eviction.

Hopefully your roommate will get hopping after you post the 5 day pay or quit. Make it clear to your roommate that if he is evicted, that is a civil court case that the judge will/can award you a judgement for all rent due which you can collect via any normal means including garnishing his wages. Additionally, the eviction judgement will show up on any background or credit check for I believe 7 years and could be considered when he is trying to rent in the future or possibly get a job.

You serve him a 5 Day Pay or Quit, and if he pays then he gets to stay so be prepared for t hat. If you just want him out and you can deal with not getting the rent, then serve him a 30 Day "no reason" to vacate.

An Unlawful Detainer is not served after a 5 Day Pay or Quit, but it is after other Notices including a 30 Day, has expired and the person has not complied.

Decide which you want to do then get a private process server or the Constable to serve it for you so t hat you can be sure it is done properly. It is not all that expensive and these notices do not have to be personally served, so if he's not home when they come, no matter.

There's the cival way as others have suggested or the way I've done it in the past which is to threaten them with bodily harm.

Just wait until the guy is gone and move all his stuff into storage and change the locks. You say he has a month to month lease, is that with you a renter or owner? Sounds like you may be sub-leasing which in that case the guy is not even on the landlords lease.

Seriouslly just kick his a$$.

I ended up with someone who rented a room from me in Phoenix who was nothing short of a psychopath, who I lived in fear of. He'd say: "You don't need my rent money, quit pestering me!"

Well, short of even paying his deposit and first month's rent somewhere else, and that didn't work, I ended up selling the house! When he came home one day and saw the For Sale sign on the lawn, only then did he start packing!

Let's hope you have an easier time of ridding yourself of this person, than I did, and you're not threatened with harm.

Hmm, sounds nice, but do you really want to deal with the legal issues you'd put yourself into for this? Threatening with bodily harm sounds like tough love, but try telling that to a judge. Locking someone's stuff up without their permission seems cool in the movies, but can easily lead to charges of theft.

As stated in the post: it doesnt even sound like the "roommate" is on the lease. I had a nightmare roommate one time who I kicked out on the day he didnt pay. He called the cops on me and they asked me nicely to let him get his stuff and to not harm him.

Seriosully, would you just sit there and do nothing? Not me, I'll deal with the issue any any consequences later. Life is too short to deal with peoples BS.
