Another related thought. Potential tenants may use this site to research potential landlords: ratemylandlord.com | landlords | search for landlord It could be interesting to research yourself OP and see what your LL rep is.

Past payment performance becomes virtually meaningless because so much has recently changed. I would be largely on the LL's side.

In contrast, if it appeared likely she would be able to stay current financially moving forward and has every intention of doing so, and simply fell on a temporary unforeseeable hard time, then I would agree more with your premature conclusion.
I agree with you, I have little information to base my opinion on, But the speed that the LL acted (she being 8 days or less late with her rent) to start the eviction process seems 'harsh' to say the least.

he is also holding her security deposit, and appears to have not actually spoken to the tenant, just (as he has stated) is more then 3 days late, then she is out.

I am saying (and have said) that the OP needs to treat the tenant as a HUMAN BEING, not as a ATM that spits out cash on the 1st of the month.

Now if the tenant did fall into drugs, or other problem, the OP really needs to state that, but if its just being late with the rent... then....

The tenant should not be having any problems paying rent after a bankruptcy since other bills were discharged. If they are late anyway, that is a very, very bad sign and I would want the tenant out as fast as the terms of the lease stated and laws allowed.
If the tenant expects to have the money to pay in a few more days, the tenant can pawn something or get a payday loan to make the rent. If they don't have any way to get the rent money, then the landlord is just going to lose money every day they delay putting a new, paying tenant in.

How many months of rent have you donated in your lifetime?

It's easy to be generous with everyone else money.

I have never had to 'donate' a penny toward someones rent, because I have always been flexible with my tenants, I have always gotten paid †

Jonathan

† YES, I have gotten 'stiffed' on rent, and lost some money and had to evict bad tenants, but I am not going to let a few 'bad apples' ruin it for mostly decent people.

I'm not sure I understand. You said "I have always gotten paid" but then said "I have gotten 'stiffed' on rent, and lost some money". This seems to be contradictory statements. Could you clarify your statements or point out my error in interpretation please? I feel I'm probably missing your point.

Getting stiffed on rent is the same as donating the rent money to the tenant. You are essentially paying the tenant's rent for him, and simply paying it to yourself on his behalf. He gets a free ride from your "donation" while you end short the donation amount compared to where you'd be if he had declined your "donation" and paid the rent himself instead.

Forgive me, I see the circular logic in my last post, what i should have said, is, that the people who I was flexible and gave them room to breath, always paid the rent.

The deadbeats have always been deadbeats.

how do you know the tenant has filed bankruptcy? Did you look through their mail? BTW if the tenant is paying their rent on time what does that have to do with thier private biz of filing for bankruptcy.

Sinister,

Just a suggestion, it's strictly a personal decision but why not try "killing with kindness"? Get a pumpkin pie and sit down with them over coffee and work out a suitable arrangement. Try and be firm but fair. You will feel alot better about it afterwards knowing that you didn't put a baby out on the street in July in Hades.

Godd Luck!
