Jurisdiction is North Las Vegas. The tenant gave her notice through section 8 to be out by the 30th. Doesn't look like that's happening. Do I need to serve the "FIVE-DAY NOTICE TO QUIT FOR TENANCY-AT-WILL" first and then serve the unlawful detainer notice or can I just go straight to the unlawful detainer as tenant is breaking her own vacating date?

The lease is over by its own terms. There's no need for you to terminate the lease through the 5-day notice to quit. Just file the 5-day notice of unlawful detainer.

In live in 89107 zip code (las vegas) ...my fiance & i were living with my foster mom's daughter , who died 2 months ago...we stayed on to avoid homeless ...now landlord wants to talk to deceased. What are our options and/or rights do we have, if any ?! Please �� help...to hot here too be HOMELESS !!!

If you aren't on the lease, and can't afford to rent it yourselves, I don't think you have any "rights" in that situation. I assume the landlord wants to talk to the person who has been dead for two months because the rent hasn't been paid. If you can't pay it, you are going to need to move. Soon.

In nevada do you need to respond (answer /affidavit) to the first 5 day notice in court or do you wait ?

There are organizations in the valley that work to prevent homelessness. I suggest you google " need help paying bills Las Vegas" and " help of southern Nevada "

Of course you should answer any legal notice as quickly as possible.

Well, that depends. Do you want to be evicted?

If the 5-day Notice is because you have a valid lease, but you haven't paid the rent, your options are:
  1. File an Answer with the Justice Court before noon on the 5th day,
  2. Move, or
  3. Pay the damn rent.
If you don't do one of those 3 things, you're going to be evicted. The way that will happen is that the Landlord files a Complaint with Justice Court. If you filed an Answer to the Notice, a hearing date is scheduled. If you didn't file an Answer, the Judge then signs the eviction order, and you're off to the races.

if you do not move within 5 days you wlil be evicted, by force and locked out if necessary. Add in court costs, clean up costs, a 'reasonable' charge by owner to store your stuff. Like me, they will track you down go after any wages until u pay up 100%.

Get smart at leave. Eviction is swift in NLV, you will be out within 10 days.
