Hi all so this is my situation. I have gotten approval on mortgage, gotten HOI and paid one year in full, got all papers that needed to be signed, signed. There was a open permit on the title report so the mortgage broker asked me to contact my lawyer, I did and she called and left a number of messages with the sellers lawyer. Without this permit being closed we can not close this issue has been on going. We contacted him (the sellers lawyer) 3 weeks ago about this and my lawyer said she has called him at least 8 times about this and has not heard anything back. They wanted to close this week (it was in our contract) but since he hasn't gotten back to her about the open permit we can not this is so annoying being that we have a time we need to be out of our current place and need to do some work on the house ahhh anyone have any ideas on what i can do. I called my real estate guy to see if he can ask the seller but i dont know what else to do.

Yes. It is frustrating. Unfortunately this kind of thing goes on all the time. The buyer has very little leverage in this situation. About all that you can do is threaten to walk away (assuming that you are beyond the contractual time frame that would allow you to do so).

Hmm so annoying, you would think that people would just do their jobs. . . all it is doing is getting me stressed. Which isnt the best thing for a pregnant women.

Maybe the seller has had a change of heart on selling. Thus stringing you along so you back out? Wouldnt be the first time I heard of it.

Depending upon what the open permit is for you may be able to close with an escrow. This of course would have to be approved by the lender and the title company (and most of all you). Then again, if the seller's lawyer is not returning phone calls, this possibility cannot even be discussed.

The seller is selling an estate her father died and she is selling the house, I was at the house the other day to take pictures for the HOI and the women said she cant wait to go home and hopes we close soon, so she didnt have a change of heart. . . the permit is for a second story to be added on it was opened in 1990 and nothing was ever done with it. Its so annoying

So, you know the work was never done? I would be concerned if the work had been done, but never closed out (no co). People on this board have mentioned that keeping the permit open was a good way to avoid paying taxes on improvements... but if the work was never done, it just sounds like a very lazy lawyer. Has the seller called her lawyer?

Good point. I was assuming that the second floor was actually added. If not, it is a much simpler process to get the permit closed.
