I agree, but it is up to the pedestrian to make sure he or she is not in a car's path. Keeping your back turned to cars is stupid. Expecting a car to see a black suit at night is even stupider.
You shouldnt be walking in a street at night .....
Didnt mean you personally... People in general shouldnt be walking on a street at night in dark clothes. This is just common sense.
I think there are even laws about it places.
My girlfriend lives in New Rochelle, which has a high Jewish population and it's a religious practice of theirs on Saturday to be walking....all day long. I did think it ended at sunset, but I'm hardly up on that.

As I understand it, sunset occurs when the "bottom" of the Sun first touches the western horizon and sundown is when the "top" of the Sun goes below the western horizon, and it takes 42 minutes for the Sun to go from sunset to sundown.
