I was parked next to a Catholic School on May 9th, Holy Ascension Thursday. School was NOT in session.
The parking sign read:
No Stopping 7:00 a.m. to 4:00 p.m./School days (except school buses)
However, I received the ticket regardless.
I wasn't sure if this parking rule applied to ALL schools(including public) in the town or just the school the parking sign is next to. Which lead me to call 311 in the past. The operator confirmed that if the school next to the sign is not in session, I can legally park there.
What are my chances of fighting this ticket and winning?
Is there anyway to get this dismissed without going to court?

Thank you.
The ticket will probably be dismissed but you have to go to the court to do it. And pay the $30 administrative fee. Bring a picture of that parking sign.

Why would they have to pay the admin fee if the ticket gets dismissed? Sounds like a good way for the county to still collect money by writing tickets they know will get thrown out...

That was my thought exactly. I got a ticket dismissed last month and was all smiles until the judge said pay the $30 administrative fee. It is a scam!!

Thats a scam, how can that be legal to pay an admin fee when you arent guilty, which means you should have never been there in first place....
The ticket is $70, is there a way to get a REDUCTION and NOT go to court? How much do you think a reduction will be?
Tming, what was your ticket about?
Thank you everyone
My ticket ($120) was parking without a permit in TOB parking lot. Your ticket is not worth going to court for. You will only save $40. Read the back of the ticket, it should have instructions on how to appeal it.
What time did u get the ticket? Whether or not school was in session bc of the holiday, Thursday is a school day and if the sign didnt say holidays are exempt well then you got the ticket for the proper reason.
Admin fees will often be assessed if you forgot to display a permit, or if you had a legal excuse but it wasn't evident when you are ticketed.
If the ticket is in complete error the ticket will be dropped and you should -not- be assessed any fees.
in NYC no parking in a school zone means any time the school is in session. This -could- be summers, weekends, holidays, etc. Even if you are aware of the school schedule you really should never park in a school zone during those hours.
For ToNH, just go, appeal because you didn't think Catholic School counts and see where it goes. 50/50.

I would add like another poster bring a pic of the sign to show the judge the exact wording.
PLUS go to the Catholic School and ask them for documentation that they were closed that day: a copy of their official school calendar, a brief courtesy letter to the court typed up for you, a copy of a bulletin they sent out to parents advising that school was closed for Holy Ascension Thursday, etc.
Another thing you may try is bring your proof to the Clerk of the Court beforehand and see if s/he will throw out/invalidate the ticket as a mistake and you might not have to even see the judge. In some jurisdictions this works, however I don't have specific experience with TONH, so YMMV.
