Hi, I would love a response from an immigration attorney and/or someone who has been through a similar situation. I am attempting to apply for SNAP benefits but am hesitant to list my undocumented parent as part of my household because I am worried about the possibility of putting them on the radar for USCIS/ICE. I did a bit of research and learned that the information is confidential and while the government will crosscheck their status with ICE, they won't request documentation. Still, with the current climate around the detention and deportation of undocumented immigrants, I am worried that by including them as part of my household on a government form, I will be putting them in danger.

For those who have had experience with SNAP and undocumented immigrants, is the confidentiality truly upheld? Is it wise of me to include them?

Your parent is not eligible and should not be included. You may not be found out, but it is not appropriate to include your parent. You have been told. Obviously what you do is up to you, but you now know the rules.

"Who is not eligible? Some categories of people are not eligible for SNAP regardless of their income or assets, such as individuals who are on strike, all unauthorized immigrants, and certain lawfully present immigrants.

In general, lawfully present immigrant children, refugees, and asylees, and qualified legal immigrant adults who have been in the United States for at least five years, are eligible for SNAP. In some cases, the income and resources of the immigrant’s sponsor count toward the immigrant’s eligibility. For detailed information on legal immigrants’ eligibility for SNAP, see http://www.fns.usda.gov/snap/snap-policy-non-citizen-eligibility."

"SNAP eligibility has never been extended to undocumented non-citizens. Specific requirements for non-citizens who may be eligible have changed substantially over the years and become more complicated in certain areas. If certain members of a household are ineligible for SNAP, state agencies must still determine eligibility for SNAP for any remaining household members who are seeking assistance."

Your undocumented parent is ILLEGAL. What part of that makes you think they are eligible for any benefits?

Instead of applying for food stamps, why not put the energy into getting your parent in the US legally and then they can get a job and will not need food stamps?

If your parent is undocumented, simply apply to USCIS/ICE for the proper documents.

Unless you're a white European - Immigration Laws have always been biased -designed against minorties. There may be a 15 year wait . Are you telling me you have never heard this or read anything aside from a City_Data Post or a meme?

Look into the many visas they may qualify at USCIS.GOV.


If you are a legal citizen you may be able to sponsor them, just keep in mind living on government assistance will disqualify you from many of them... but COVID may have caused that stipulation to be waived.



Just remember if they are caught undocumented and you are found to be providing them shelter it can be bad for you legally. You get caught housing them and collecting SNAP in for them it will be REAL BAD for you.



You can try asking this question on visajourney or avvo as they have more specialists in immigratikn who can advise you better.

Here's a hint. Immigrants are in general minorities.

I deal with documented and undocumented aliens for a living.

I know much more than you ever thought you knew on this subject.

My experience comes from dealing with actual immigrants and Homeland Security not an internet search or meme.
