The Planning Commission has approved the Zeigler Boulevard Apartments at the intersection of Cody and Zeigler across from the Fairgrounds, totaling 732 units in 3 phases. This brings the total number of housing units approved so far in the city to 2,480. which dwarf's the county which is at 1,345 housing units.



Unfortunately though we are running out of new housing projects to approve, as of today there are only 2 housing projects waiting to be approved, A new 75 lot subdivision on Moffet Rd and the 9 units Bungalow Court on Church Street just outside Downtown

A lawsuit in Fairhope has the potential to shake up development in the city, just as the city’s one-year moratorium on development comes to an end.

Last week, 68 Ventures, a development company based in Daphne, filed a lawsuit against the city of Fairhope and the city planning commission, alleging that the city denied the company due process, as well as denial of equal protection and misrepresentation after rejecting two planned multi-unit developments in the city.

On Friday, Baldwin County Judge Scott Taylor reversed the Baldwin County Planning Commission denial of the Sherwood Grove subdivision and ordered the planning commission to approve to plan.

This is the same company, 68 Ventures, that is currently suing the Fairhope Planning Commission over the denial of an apartment complex. The company is seeking damages of more than $10 million in a federal lawsuit in that Fairhope case. This ruling could signal what could happen in the Fairhope case. The Sherwood Grove case is a state lawsuit.

Basically, the cities on the Eastern Shore(not just fairhope)all set these companies up for failure about 15-ish years ago when they lobbied the County to change the rules, did so, allowed them(development companies) to set plans into motion(survey land, buy property, and so on) and then tell them they cant develop it.

they have 2,800 lots currently under construction with multiple delays not counted in that list because of the moratoriums and denials , which based on this ruling are probably going to be reversed as well. Looks like Baldwin County may be back open for business
