That's an unfortunately typical problem with HOAs and covenants everywhere -- you can get dinged for what you don't as much as for what you do. HOA or covenants are both killers on any RE deal for me, for those and other reasons (I've yet to see a HOA where the money collected didn't magically trickle away).
