I live in an apartment with three other people. One of them has all of the utility bills in his name. The four of us all pay an equal split of each bill every month. I have not missed a single payment. In a fit of anger, the roommate that has the utilities in his name, shut of the breaker for my bedroom so I would not have power in my bedroom, and refused to let me gain entry into the room with the circuit breakers, because he could not find a plastic utensil. Is there anything I can do about this? If there is anything, what are my legal options?

small claims court - what would you want as an outcome? kick him out?

OR just have your power turned on. It's money out of your pocket. Personally, I'd beat the crap out of him.

Legally, go to the police department and file a complaint against the room mate. Technically, he is stealing from you.

I suspect you'd spend more in small claims court than it's worth. legal options: move, kick that one out and get a new roomie or split 3-ways. If he's going to be that petty over something like a utensil, what else is he going to do next?

I think small claims court costs $75. Surely this plastic utensil costs less. Buy a new one (or two) and save yourself a lot of grief. Then find new roommates.

Is your name on the actual lease? Whose name is on the lease? Do the four of you have anything in writing. Could you give a little more information?

He/she can be held liable for any damages you incur while the power is left off. Get your documentation showing on time payments and call the agency in your city/town that deals with landlord-tenant disputes (it doesn't matter if she/he is not your landlord). Bottom line he/she has NO LEGAL RIGHT TO SHUT YOUR POWER OFF. Call the police, and I won't go so far as to suggest that you have an accident (trip over something in the dark while in your room), but she/he is responsible if you hurt yourself, and woul have to pay any medical bills, plus an amount for pain and suffering. Again, not saying have an accident, but if it happened that you legitametly hurt yourself, she/he would be responsible. I can't believe your forced to live under these conditions and strongly suggest that your best course of action may be to move.
