our child is 18 and we suspect drugs addiction......can we get legal action to declare him incompetent to get him into rehab......have the back up of a conselor........feedback ....thanks
If you google this you will find some answers, but the ones I saw say it is expensive and complicated. He also must show more risk to himself/others more severe than just being addicted to drugs All the sites said you will need a lawyer, and that the adult child will also be provided with a lawyer by the court to fight it if he wishes.
What did the counselor say? I would assume he knows about how these things work?
Didn't ask counselor.....but that's what I will do on Tuesday for sure....
was wondering......will speak to counselor and find out from him his take on this......haven't discussed this potential legal action we might take with the counselor but am going to.....

This would require an involuntary commitment, very difficult to do as ocnjgirl indicated.
It is quite a process getting a psychiatric patient (who is out of touch w/ reality) committed.
I have seen folks who have been court ordered to outpatient treatment but that was after multiple criminal offenses, in one case multiple DUI's, last one resulted in the death of his passenger.
One thing to consider, how effective will the treatment be if he is forced and not ready?

Very unlikely. People have too many civil rights to allow that. Unfortunately, being drug-addled and maybe getting sick or in trouble or dangerous situations do not warrant involuntary commitment. Also, many many rehabs/detoxes will not take someone who isn't voluntary, because if they don't wanna, they aren't gonna.
I think all someone around this person can do is tough love, at least, no money, and consider kicking him/her out of the house. If drugs and the life will kill them, it'll do so whether or not that person is living in your house. Sounds harsh, but I've worked in detox with adults and that's how it goes. The person has to want to get well at least as much as you want him to, and he has to get that there is something to lose that he doesn't want to lose.

While I feel bad that your child has become addicted, I can't see how his parents declaring him incompetent is going to give him the incentive he needs to get better....sorry, if anything (I think) it'll just make him angry, and less likely to come around to see you, let alone for help when he is ready.....
My husband and I r good parents and feel we did a good job with our child.........I suspect the tragedy of losing his best friend ......his grandpa my dad whom lived with us for 20 years...The summer before my dad passed my child drove his grandpa 3 times a week to doctor visits for the summer, the fall came around my dad died...My son helped rescue ferrel cats to have them spayed/neutered....Amongst many other good deeds......I think depression and sadness have made him vulnerable to bad things around him which drug wise once u try I believe u can't have clear judgement especially if it becomes a habit........Hey good people make bad decisions......I understand our children need to make mistakes in order to learn a lesson and then move forward.....maybe some of us are more vulnerable than others in being able to move forward.......Maybe some of us need the help of others......and when I mean help I believe my child needs professional help ........

I agree. My neighbor, now my friend, had to force her son into rehab. She told him to pack a bag or go to rehab. Unfortunately, he had to go to rehab three times before it stuck. Fortunately, he's been clean for 18 months. Once, when she threw him out of the house, I put him up for a month. We've known him since he was twelve years old and was/is a friend of my son. I'm pretty sure that she was happy that he didn't have to live under a bridge.
I'd tell him to go to rehab or pack a bag and leave. Mean it; do it.
deeds- I do not have any advise for you.. I will say a prayer that it works out and your Son comes thru this. Be strong..
