you cant really do that since the trial is supposed to ensure that the person punished is the guilty party. but once they are found guilty, they should be killed with a cheese grater.

I probably wouldn't want to use the cheese grater afterward for grating cheese, though.

Reminds me...I have a friend who was married to this man whose parents were divorced. The reason that his parents were divorced was that his father suffered from some sort of mental illness, and one night when his mother was sleeping, his father took a baseball bat and beat her head in. She survived, but was badly injured and hospitalized for awhile.

She divorced him, and he went into a mental institution. Eventually he got out and was able to get an apartment and live on his own with medication. She would visit him on weekends, but went home to her own house and wouldn't live with him full time again.

The kicker is that it was my friend's husband's bat that his father had used to beat his mother's head in. He retrieved the bat from the bedroom, cleaned off Mom's blood, and used it again, because it was, after all, his "lucky bat" that he hit best with when playing on the company softball team.

Isn't that Aggravated assault. Why wasn't he sentenced to do time in prison.

You really think that the police did not seize the bat as evidence?

She mentions that he did time in a mental institution. Probably was either found incompetent to stand trial, or was found Not Guilty by Reason of Insanity, then kept in the loony bin until some doctors declared him stable, then released.

a girl that worked for me had a situation where she woke up to her boyfriend wailing on her face with a baseball bat. i dont know what legal issues came of it, im pretty sure she stayed in a relationship with him.

Actually, they can! Evidence can usually be held while a case is pending, and during appeals as well. This is something which has helped exculpate some defendants years later.
