So my question is, if you have a roommate not on the lease and they have been living with you for quite sometime and your done with the way they live can I find a new apartment and just leave...I cant get rid of them cause they got no where to go, so if I look and find a place, get my **** and go, I can do that. I dont have to takevthem with me...right??

Since they’re not on the lease, if you leave, then the roommate has to vacate as well. After that, you’re not obligated to take the roommate with you obviously and everyone goes their separate ways.

Unless you notify the landlord that you’re leaving and you have someone that wants to keep the apartment. It’s up to the landlord to decide if they will let them stay or not. They might appreciate a continuation of receiving rent and not having to find a new tenant. Or they will want the apartment vacated in order to renovate and charge the next person more.

FYI, having a roommate without listing them on the lease or notifying the landlord is usually considered a breach of contract.

No my landlord knows..no noise, no parties, I am a stellar tenant. its just a matter of me wanting to be on my own and not have the way they live impede on my way of living when the two just dont mesh. Thanks for the reply.

I dont have a responsibility to another grown person, unless Im a guardian or something. If its just me wanting to leave I didnt want to abandon them in any way. so if I give them as well as the landlord proper notice, when the time comes, I go my way and they go theirs. If I would have an abandonment issue then Id want to resolve it the best way for both of us. But fact of the matter is I can leave and not take ppl with me.

There are some weird laws that exist but I am not aware of any law that says once you allow someone to live with you that you always have a legal obligation to continue to provide accommodations for them if you move to a new place. It is too bad that you will have to move to finally be able to live without that person. Hope it all works out for you!
